Patents

For many years, industry leaders and entrepreneurs alike have selected Munck Carter attorneys to help protect their most important inventions. Our experienced, intelligent, highly trained patent professionals are privileged to represent some of the world’s largest technology companies, for which we have successfully prepared and prosecuted thousands of patent applications. We are equally proud, however, to offer the same exceptional service, creativity, commitment and common sense cost structure to entrepreneurs and emerging businesses. With 15 licensed patent attorneys, Munck Carter has one of the strongest patent prosecution teams in the southern United States.

We prepare and prosecute utility and design patent applications across a full spectrum of technologies. Our attorneys have developed particular expertise in the wired and wireless telecommunications, medical device, firmware, software, hardware, energy and pharmaceuticals industries. We also have significant experience with business method inventions and the offensive and defensive use of patent reexamination proceedings. Through our extensive global network of foreign associates, we help our clients assess, secure and enforce patent protection worldwide, including patent prosecution under the Patent Cooperation Treaty.

Our patent attorneys have wide-ranging technical backgrounds, including specialized or advanced degrees in areas as diverse as electrical engineering, computer engineering, computer science, mathematics, physics, chemistry and molecular biology. A substantial majority of our intellectual property (IP) lawyers also bring to bear practical work experience in our clients’ fields, and are as much business professionals as they are experienced lawyers. These skills enable us to work directly with your scientists, programmers and engineers in their particular area of expertise. Nor is this the only way we “speak your language.” Our firm includes attorneys fluent in Mandarin Chinese, Korean, Spanish and Italian.

In addition to assessing patent rights and procuring patent protection, we regularly negotiate and prepare a full range of agreements related to inventions, patents or patent applications, including development, manufacturing, joint venture or license agreements. We represent clients in transactions involving the grant of security interests in inventions, patents and patent applications, or the assignment, purchase or sale of these critical assets. We also provide comprehensive portfolio management, IP audits and legal opinions, and conduct patent due diligence for business combinations, financing, licensing or litigation matters.

Our patent lawyers team with our trial lawyers and litigators both to enforce our clients’ patent rights and to defend our clients against infringement claims. We have extensive experience handling patent disputes as plaintiff and defendant. Our clients have called on us to represent them in federal district courts around the country, before the United States Court of Appeals for the Federal Circuit, and in interference or reexamination proceedings before the U.S. Patent and Trademark Office.
